E&P field development projects are not always commercially viable – what happens when partners disagree?

After the consortium members of an Exploration & Production (E&P) field development project determined the project was commercially unviable, one partner filed a claim challenging the decision. We evaluated cost studies, development plans, and the decision-making process to assess the adequacy of exploration and appraisal work necessary to inform a risk-based decision on commercial viability. In addition, Baker & O’Brien prepared an expert report detailing the essential phases of E&P development projects and provided opinions on this project's technical and commercial aspects.

Disputes between owners and EPC contractors, are often about schedule and budget. Baker & O'Brien was engaged to opine on the impact of the extreme climate location on project execution considering personnel capabilities and the quality of fabrication and construction work. Our findings pertaining to mitigation plans, field modifications, logistics plans, site living conditions and labor productivity were presented to an arbitral tribunal in report and orally.

Crude Oil by Rail Terminal - Project Development Dispute

The development of a crude-by-rail (CBR) terminal project did not progress as the joint venture (JV) parties had originally expected. In the dispute, the Claimant contended that one JV party interfered with development progress, the Defendant responded that the Claimant did not achieve critical milestones required to sanction the CBR project. Baker & O'Brien provided an expert report that analyzed development activities, economic assumptions, industry trends, prevailing commercial conditions, and review of a valuation model.
